Contract of Residency

 

Stream of Life Sober Living is a transitional living facility for individuals who are recovering from alcohol or substance abuse. Residents are subject to substance testing at any time while living at Stream of Life. ANY USE OR POSSESSION OF DRUGS OR ALCOHOL IS GROUNDS FOR IMMEDIATE EXPULSION.

 

All policies and procedures outlined within this contract and any applicable subsequent amendments remain in full force and effect during Resident’s entire stay at Stream of Life Sober Living unless otherwise specified within this contract. Violation of any policy or procedure outlined within this contract or any applicable subsequent amendments will result in disciplinary actions including, but not limited to, financial penalties, limits on house use or privileges, , and possible expulsion from the sober living program.

 

  1. PRIOR TO OR UPON ARRIVAL, RESIDENTS MUST:
  • Complete the Resident Application and Information Form.
  • Submit to a drug and alcohol test.
  • Execute this Contract of Residency.
  • Execute the Stream of Life Sober Living Drug Screen/Test Acknowledgement.
  • Execute the Stream of Life Sober Living Resident Release Agreement.
  • Read and sign Stream of Life Sober Living Life360 GPS Policy.
  • Read and sign Stream of Life Sober Living Automobile Policy.

 

     2.RESIDENT’S PAYMENT OBLIGATIONS

  • Residents must make an Initial payment of $Text field, which includes the following components:
    • $Text field as a Security Deposit;
    • $Text field Rent for the first full month of residency (the “Prepaid Rent”)
  • Beginning on the first day of the month following the month in which residency begins, and continuing on the first day of each month thereafter, Resident shall pay rent equal to $Text field. The first such monthly payment shall be prorated such that the sum of this payment plus the Prepaid Rent shall equal one (1) full month’s rent and one partial month’s rent based on length of time the resident occupied the facility before the first full month. For example, if residency begins and the Prepaid Rent is received on the 15th of a 30-day month, the payment required on the subsequent first day of the month shall be one-half of the payment normally required for monthly rent.
  • Payment shall be made by check or electronic transfer using payments platforms and methods to be determined by Stream of Life Sober Living.
  • Resident shall be subject to a Two Percent (2%) penalty applied to the past due payment for each day that a rent payment is past due.
  • Failure to pay required rent which persists for more than fifteen (15) days after the initial due date may result in a resident’s expulsion at the discretion of the House Manager or Head of Household, in which case the resident remains obligated to pay the past due amount plus penalties. Additionally, any resident expelled from the facility for failure to pay any required rent shall forfeit his Security Deposit.

 

 

 

 

 

    3.Rules, Regulations and Resident Responsibilities (“House Rules”)

  • All residents must complete the post-residential treatment aftercare program (i.e., therapy, IOP program, etc.) prescribed to them by the referring inpatient treatment center or counselor; residents must also sign a consent form authorizing the referring treatment center or counselor to release any aftercare plan prescribed to the House Manager or Head of Household.
  • All residents must have and maintain a sponsor and provide the name and phone number of his sponsor to the House Manager.
  • All residents are required to own a big book of Alcoholics Anonymous (AA), Narcotics Anonymous (NA), or Cocaine Anonymous (CA), as a resident may choose based on his personal situation. All residents must actively work the 12 Steps of their applicable AA, NA or CA program and must report on their progress during each nightly wrap-up meeting and/or the Sunday house meetings.
  • All residents must submit to random drug and alcohol testing per the terms of the Stream of Life Sober Living Drug Screening Agreement which each resident executed prior to occupying the facility.
  • RELAPSES WILL RESULT IN THE RELAPSING RESIDENT BEING REQUIRED TO COMPLETE AN INPATIENT PROGRAM BEFORE THE RESIDENT MAY SUBMIT AN APPLICATION SEEKING TO RETURN TO STREAM OF LIFE SOBER LIVING.
  • All residents must subscribe to the Life360 app with GPS access toggled on at all times, and provide access to monitor residents’ location to the House Manager and Head of Household. Further, each resident will keep his cell phone on his person and sufficiently charged to allow the continuous operation of the Life360 app and its GPS features. If a resident must disable GPS features, he may do so only after contacting the House Manager and obtaining verbal approval to disable the GPS features.
  • All residents are required to attend every morning meditation (8am each day from Monday through Friday) and every evening house wrap-up meeting held Monday through Thursday (generally at 9 pm or as otherwise scheduled by the House Manager).
  • All residents must attend the mandatory house meeting each Sunday at 9pm (or as otherwise scheduled by the House Manager or Head of Household).
  • All residents are required to sign in and out of the property. Signing in and out of the property requires the resident to note their time out, time in, destination, and a mobile number to reach them.
  • Residents are not permitted to operate any type of business from the house or its premises.
  • Physical intimacy between residents is prohibited.

 

 

 

 

  • Immediate dismissal will occur upon the following:
    • Use of drugs or alcohol on or off the property.
    • Refusal to provide a urine sample or complete a sobriety test immediately upon request.
    • Knowingly failing to inform the House Manager or Head of Household that another resident is using drugs or alcohol.
    • Failure to abide by the Life360 app requirements as outlined above.
    • Disruptive behavior, as determined in the sole discretion of the House Manager, including without limitation:
      • Physical Violence or threats of physical violence;
      • Abusive verbal behavior;
      • A “chronic” bad attitude;
      • Gambling;
      • Destruction of house property;
      • Repeated loud music, television, radio, musical instrument or other noise source;
      • Theft;
      • Arson;
      • Breaking confidentiality;
      • Abusive/loud arguments;
      • Possession and/or use of weapons.
    • Resident Responsibilities
      • Residents must respect the confidential nature of all information shared with them by other residents, the House Manager and the Head of Household. Information about a resident’s recovery and House business are confidential topics that must not be discussed outside the house; violations of this policy will be grounds for immediate expulsion.
      • Residents are expected to always maintain a respectful noise level while in the House
      • All residents must act in a way that demonstrates respect for one another, the House Manager, the Head of Household, and the facility.
      • All residents must maintain normal standards for personal cleanliness and hygiene.
      • All residents ,must keep their bedrooms and bathrooms clean and orderly and make their beds daily. Bedrooms and bathrooms are subject to inspection at any time by the House Manager or Head of Household.
      • All residents must complete the chores assigned to them by the House Manager by 9am on Monday through Friday and by 11am on Saturday and Sunday. Residents must plan their days to permit the timely completion of the chores individually assigned chores to them.
      • In addition to individual chores, all Residents must collectively participate in fully cleaning the House each Saturday before 11 am. No resident may leave the premises prior to inspection and approval of the group cleaning project by the House Manager or Head of Household.
    • Visitors
      • All visitors must be pre-approved by the House Manager or Head of Household.
      • Visitors are allowed in the common areas only, and never in bedrooms or hallways.  

 

 

 

 

    • Smoking
      • Smoking inside the house is strictly prohibited. Any violation of the non-smoking policy will result in the offending resident being placed on house restriction, paying a house cleaning fee, and possible expulsion.
      • Smoking is only permitted in outside areas as determined by the House Manager. Residents are responsible for picking up and correctly disposing of their cigarette butts.
    • Lock Down
      • The House may be placed in a state of lock down at any time.
      • Lock down status will be communicated to residents by the House Manager or the Head of Household and takes effect immediately upon announcement.
      • Lock down requires all residents to remain in, or immediately return to, the house, and may also include restrictions on use of phones, television or other amenities until the situation causing the lockdown is resolved.
      • Residents who are outside the house at the time lock down begins must return to the house immediately, except for residents who are working during the lock down announcement, in which case, those working residents should return immediately upon completion of their scheduled work.
    • Termination of Residency
      • Upon termination of residency for any reason, the departing resident must thoroughly clean his bedroom and bathroom.
      • Upon expulsion, personal belongings must be picked up within seventy-two (72) hours or the belongings will be stored for thirty (30) days by Stream of Life Sober Living, then repurposed, donated, or discarded.
      • Resident must have fully paid any past due rent including penalties prior to being provided any personal belongings stored by Stream of Life Sober Living.
      • Prepaid Rent and Security Deposits will not be refunded to any resident expelled for a rule violation or relapse.
      • All residents must provide a written, thirty (30) day notice to the House Manager or Head of Household to voluntarily terminate their residency.

 

These House rules are subject to change upon reasonable prior notice.

 

  • Write ups and Behavioral Correction Plans.

At the discretion of the House Manager and/or Head of Household, certain rule violations or failures to fulfill resident responsibilities (“Conduct Violations”) may not be treated as grounds for expulsion. In such cases, the House Manager and/or Head of Household will document the specific Conduct Violation (a “write-up”) and meet with resident to develop a written plan to correct the Conduct Violation(s), which shall be signed by the resident (a “Behavioral Correction Plan”).

 

The Behavioral Correction Plan may contain certain consequences for the Conduct Violation such as dish duty, earlier curfew, house restriction(s), copying a section of the Big Book, etc., as well as predetermined thresholds for any additional Conduct Violations that would result in the resident’s expulsion from the house. Repeated Conduct Violations will be grounds for immediate expulsion from Stream of Life Sober Living.

 

 

 

 

 

 4. Stream of Live Sober Living Phasing Policy

In addition to abiding by the House Rules outlined above, residents will progress through “phases” based on their duration of residency, the length of their continuous sobriety, and the degree to which they demonstrate respect for and adherence to House Rules. The following additional requirements, restrictions, rules and obligations will apply to each resident based on each resident’s classification into Phases 1, 2, 3, or 4.

 

Phase 1 - First Two Weeks

  • If resident has a vehicle, his keys will be surrendered to the House Manager at the time of move in.
  • House Manager will only provide vehicle keys for a resident’s travel to/from his place of work, an Intensive Outpatient Program (IOP), volunteer work or other medical appointments.
  • Attend all evening wrap-up meetings on Monday through Thursday and each house meeting held on Sundays.
  • Curfew is 10pm from Monday through Saturday and 9 pm on Sundays.
  • No overnight passes will be provided unless approved for specific reasons at the discretion of the House Manager or Head of Household.
  • Perform twenty (20) hours of volunteer work per week. Time spent in outside employment and IOP will be credited toward this weekly requirement.

 

Phase 2 - Second Two Weeks

  • Car keys are retained by House Manager but will be provided to the resident as requested subject to the resident’s compliance with the sign in, sign out procedure and return by curfew.
  • Attend all evening wrap-up meetings on Monday through Thursday and each house meeting held on Sundays.
  • Curfew is 10 pm from Monday through Thursday, 11 pm on Friday and Saturday, and 9 pm Sunday.
  • No overnight passes will be provided unless approved for specific reasons at the discretion of the House Manager or Head of Household.
  • Perform ten (10) hours of volunteer work per week. Time spent in outside employment and IOP will be credited toward this weekly requirement.
  • Must complete the 5th step in the AA, NA, or CA program, as applicable, to advance to Phase 3. Residents shall report on their progress at each nightly wrap-up meeting and/or the house meetings held on Sundays.

 

 

 

 

 

Phase 3 – After Four Weeks of Residency and Completion of 5th step

  • Resident can keep car keys and use vehicle at own discretion subject to the resident’s compliance with the sign in, sign out procedure and return by curfew.
  • Attend all evening wrap up meetings on Monday through Thursday and each house meeting held on Sundays.
  • Curfew is 10 pm from Monday through Thursday, 12 am on Friday and Saturday, and 9 pm on Sundays.
  • Up to one (1) overnight pass for each two (2) week period, subject to approval by the House Manager. Unused overnight passes may be carried over to subsequent - periods.
  • Must complete all 12 steps in the AA, NA, or CA program, as applicable, to advance to Phase 4. Residents shall report on their progress at each nightly wrap-up meeting and/or the house meetings held on Sundays.

 

Phase 4 - After First Six Months and Completion of all 12 steps

  • Resident can keep car keys and use vehicle at own discretion subject to resident’s compliance with the sign in, sign out procedure and return by curfew.
  • Attend at least three (3) evening wrap up meetings on Monday through Thursday and each house meeting held on Sundays.
  • Curfew is 10:30 pm from Monday through Thursday, 12 am on Friday and Saturday, and 9 pm on Sundays.
  • Up to one (1) overnight pass per week, subject to approval by the House Manager. Unused overnight passes may be carried over to subsequent periods.

 

 

 

 

 

My signature below signifies that I have read and understand the terms and conditions set forth in this Contract of Residency (including all rules, regulations, responsibilities, phasing policy and other resident requirements and obligations), and I agree to abide by them. I have been provided an opportunity to seek legal counsel concerning the meaning of the terms of the Contract of Residency.

 

This Contract of Residency (the “Contract”) is effective as of Date. I Text field, will abide by all rules and regulations at Stream of Life TX, LLC (“Stream of Life Sober Living”) as outlined in this Contract and the House Rules as they may be amended from time-to-time (the “Rules & Regulations”). Additionally, I will abide and agree to additional restrictions (including any Behavioral Correction Plan(s)) that are imposed upon me if the House Manager or Head of Household, in their sole and absolute discretion, determine I have violated the Rules & Regulations. I agree that failure to pay required rent as due or my failure to abide by the terms, conditions, rules and regulations included in this Contract will result in the forfeiture of Security Deposits and/or Prepaid Rent and that I will remain obligated to pay past due rent plus penalties for late payments.

 

To the extent permitted by law, I will indemnify, defend and hold harmless Stream of Life TX, LLC, the House Manager, the Head of Household, and each and every manager, member of staff, equity owner, investor, house resident, affiliate, agent, independent contractor, and successor in interest (collectively, the “Indemnitees”) from any and all actions, liabilities, suits, injuries, demands, obligations, losses, settlements, damages, fines, penalties and expenses, including all attorneys’ fees and other expenses (collectively, a “Claim”) arising out of or related to my actions, omissions or other activity.
